Concerned Newport Beach Residents offers a mobile messaging program (the “Program”), subject to these Mobile Messaging Terms and Conditions (the “Terms”). If you do not wish to continue participating in the Program or no longer agree to these Terms, you can reply “STOP” to any mobile message from us to opt out of the Program.

Consent to Receive Messages

By signing up for the Program through a form provided on Concerned Newport Beach Residents, by giving your information to us at an in-person event, or by texting a keyword such as “Join,” you are providing your express consent and opting in to receive automated text messages, alerts, and updates at the phone number you provide.

Regardless of the opt-in method you use, you agree that these Terms apply to your participation in the Program.
By opting in, you agree to receive autodialed or prerecorded marketing and informational mobile messages. You understand that your consent to receive such messages is not a condition of any purchase.

Message Delivery and Reliability

We are not liable for any delays or failures in the receipt of SMS messages, as delivery depends on the effective transmission from your mobile service provider.
SMS message services are provided on an “as is” basis, without any warranty, express or implied. All warranties, including implied warranties of merchantability and fitness for a particular purpose, are expressly disclaimed.

Mobile carriers and service providers are not liable for delayed or undelivered messages.

Data Collection and Use

Data obtained from you in connection with this SMS service may include:

  • Your mobile phone number

  • Your carrier’s name

  • The date, time, and content of your messages

  • Any other information you provide

We may use this information to contact you and provide the services you request.

If you change, forfeit, or deactivate the phone number you provided to Concerned Newport Beach Residents, you agree to notify us immediately. Failure to do so constitutes a material breach of these SMS Terms.

Program Modifications

By subscribing or using the service, you acknowledge and agree that Concerned Newport Beach Residents reserves the right to change or terminate the service at any time, with or without notice.

Opt-Out and Help

To cancel your SMS subscription, reply “STOP” to any text message you receive. You will receive a confirmation message to verify that you have been opted out.

Supported Carriers

Supported carriers may change over time but currently include major U.S. carriers such as Verizon Wireless, AT&T, T-Mobile®, Sprint, Metro®, Boost, Virgin Mobile USA, and U.S. Cellular®, among others.

Eligibility

By signing up, you confirm that you are at least 13 years old and are either the wireless account subscriber or have the account holder’s permission to send and receive text messages under these Terms and Conditions.

Program Availability

The Program is available only to residents of the United States. You understand and acknowledge that you may not sign up for, access, or use the Program from outside the U.S. You agree to comply with U.S. and applicable export control laws and not to transfer, electronically or otherwise, any content or software subject to restrictions under such laws to any prohibited destination or person.
